On Aug. 24, 2022, the Department of Homeland Security (DHS) announced a final rule that will preserve and fortify the Deferred Action for Childhood Arrivals (DACA) policy.

The new rule:

  • Maintains the existing threshold criteria for DACA;
  • Retains the existing process for DACA requestors to seek employment authorization; and
  • Affirms the longstanding policy that DACA is not a form of lawful status but that DACA recipients, like other deferred action recipients, are considered “lawfully present” for certain purposes.

The final rule will take effect Monday, Oct. 31, 2022. However, while a July 16, 2021, injunction from the U.S. District Court for the Southern District of Texas remains in effect, DHS is prohibited from granting initial DACA requests and related employment authorization under the final rule. Because that injunction has been partially stayed, DHS presently may grant DACA renewal requests under the final rule.

Regla Final para Preservar y Fortalecer DACA

El 24 de Agosto, el Departamento de Seguridad Nacional (Department of Homeland Security) anunció que el Departamento emitió una regla final que mantendrá y fortalecerá la política de Acción Diferida para los Llegados en la Infancia (DACA).

La Regla Final:

  • Mantiene los criterios de umbral existentes para DACA; 
  • Conserva el proceso de presentación vigente para que los peticionarios de DACA soliciten la autorización de empleo; y 
  • Afirma la política establecida desde hace mucho tiempo de que los receptores de DACA, al igual que otros beneficiarios de acción diferida, están “presentes legalmente” para ciertos fines. 

La regla final entra en vigencia el lunes, 31 de octubre de 2022. Sin embargo, mientras una orden judicial preliminar (PDF, 401.59 KB) del 16 de julio de 2021 emitida por el Tribunal de Distrito de Estados Unidos para el Distrito Sur de Texas permanezca en efecto, DHS tiene prohibido otorgar solicitudes iniciales de DACA ni las solicitudes de autorización de empleo que las acompañan bajo la regla final. Debido a que esa orden judicial preliminar se suspendió parcialmente, DHS actualmente puede otorgar solicitudes de renovación de DACA bajo la regla final.
